Omni® Electronic Disclosure and Communication Consent Agreement

Please read this Electronic Disclosure and Communication Consent Agreement (“Agreement”) carefully and keep a copy for your records. This Agreement explains how CBW Bank, Member FDIC (“Bank”), CashRepublic Financial LLC (“CashRepublic” or “Program Manager”), and Omni Financial of Nevada, Inc. (“Omni Financial,” an affiliate of CashRepublic) deliver documents, disclosures, and other information to you electronically.

Collectively, “we,” “us,” and “our” refer to the Bank and its program partners. “You” or “your” refers to the individual applying for or using the Omni® Account or Omni® Debit Card (together, the “Account”).

By continuing your application, activating your card, or using the Omni® App or website, you agree to receive all required and optional communications electronically under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. §7001 et seq.) and applicable banking laws.

  1. Scope of Your Consent

Your consent covers all disclosures, records, and communications that we may be legally required or choose to provide in connection with your Account or related services, including but not limited to:

• Account agreements, amendments, and updates
• Privacy notices, fee schedules, and funds-availability policies
• Statements, transaction confirmations, and tax forms
• Regulatory disclosures (for example, Reg E error-resolution notices)
• Legal notices, adverse-action notifications, and servicing messages
• General account-related communications and alerts

Your consent applies to all communications from CBW Bank, CashRepublic, Omni Financial, and their authorized agents or service providers.

  1. How We Deliver Electronic Communications

We will provide documents and notices by one or more of the following methods:

• Posting them securely within the Omni® App or online portal
• Sending them to your registered email address
• Providing a secure hyperlink or QR code (for example, included with your physical card mailer)

We may also send alerts or reminders by SMS text or in-app notification to let you know a document is available.

  1. Hardware and Software Requirements

To receive and retain electronic records, you must have:

• A computer, smartphone, or tablet with reliable internet access
• A current version of a web browser that supports 128-bit encryption (Chrome, Safari, Edge, or Firefox)
• Software capable of viewing PDF documents (for example, Adobe Acrobat Reader)
• A valid email address that you check regularly
• Enough storage or print capability to keep copies for your records

If these technology requirements change, we will notify you and give you a reasonable opportunity to withdraw consent.

  1. Accessing and Retaining Communications

You can view or download most documents directly in the Omni® App. We encourage you to save or print a copy for your records. If you ever need help accessing a document, contact us using the information provided below.

  1. Paper Copies

Omni® is a digital-only service. We do not routinely mail paper statements or disclosures. You may request a paper copy of a specific record where required by applicable law.

You may withdraw your consent to receive records electronically at any time.  However, because this program is designed to operate on a digital only basis, if you withdraw your consent to electronic delivery, we may be unable to continue to support your Account and may close it in accordance with the Account Agreement.

  1. Withdrawing Consent

You may withdraw your consent to receive electronic records at any time by contacting us. If you withdraw consent, we may close your Account and return any remaining balance as described in your Deposit Account Agreement. Withdrawal does not affect the validity of documents previously provided electronically.

  1. Keeping Your Contact Information Current

You must keep your email address, mobile number, and mailing address current. You can update your information directly through the Omni® App or by contacting us. If an email we send is returned as undeliverable, we may treat that as a withdrawal of consent.

  1. Federal Law and Acknowledgment

By agreeing electronically, you confirm that:

• You have the hardware, software, and internet access required to receive and retain records;
• You can receive and open PDF files; and
• You consent to use electronic delivery and electronic signatures with the same legal effect as paper documents signed by hand.

  1. Changes or Termination

We may modify this Agreement or how we deliver communications as permitted by law. If a change materially affects your ability to receive documents electronically, we will notify you and, if required, ask for renewed consent.

You understand that you are not required to provide personal information or continue with the application process if you do not wish to consent to electronic delivery.
